Tobar an Dualchais is committed to respecting all rights holders’ intellectual property rights relating to material available on the Tobar an Dualchais website.
Licence Agreements have been set up with The School of Scottish Studies Archives at the University of Edinburgh, the BBC Archives and the National Trust for Scotland which enable Tobar an Dualchais to make these materials available to you. Copyright ownership remains with them in respect of the physical sound recording, whilst the separate copyright which subsists in the spoken word, songs or music remains the property of the individual contributor (unless this has been assigned elsewhere). The many fieldworkers/reporters may also own copyright in their words and each fieldworker/reporter is listed with the relevant recordings.
Licence Agreements have also been secured with individual copyright holders, enabling you to use the materials according to the guidelines set out in Terms of Use. All materials remain jointly the property of the individual contributors or their next of kin and the relevant archive holder (unless assigned elsewhere). A separate digital right in all materials is held jointly by Sabhal Mòr Ostaig and the University of Edinburgh.
Every effort has been made by Tobar an Dualchais to ensure that the reproduction of all content is done with the full consent of the copyright holders and as far as we are aware is not infringing the rights of any third party. Tobar an Dualchais aims to correctly identify individual contributors in order to credit their material. However, if you feel you have not been credited for material which you believe is your property, please get in touch with the Copyright Officer at fm.smo@uhi.ac.uk and we will remedy the situation. Although Tobar an Dualchais has endeavoured to identify all copyright holders, some material has been included where we have been unable to trace the relevant copyright holder. Also, material has been included where there are no known living relatives for contributors who are deceased. We believe the material is of such high value that we have included it in the collection in the hope that users may be able to identify the contributor and current copyright holder where possible. If you have any information which could be helpful in tracing living relatives, please e-mail us.
Tobar an Dualchais holds a PRS for Music (MCPS) licence which ensures that any contributors who are registered with them will receive royalties as appropriate.
